Unlike citizens of other countries, as a New Zealander you can jump on a plane to Australia and settle there to live and work without needing to apply for a visa - you are assigned a Special Category Visa (SCV) automatically as you pass through immigration.

You don’t have the same rights as an Australia citizen though, and not every New Zealander qualifies for a SCV. Read more about this on our Australian Visas for New Zealanders page.

Australia To Get Tough On New Zealand Criminals Moving To Australia

New Zealand criminals trying to enter Australia be warned! John Key and Julia Gillard today announced a new criminal history sharing program that means Australian immigration officials will be able to more easily identify and stop New Zealand criminals trying to sneak over the border into Australia.

Until now it has been all too easy for New Zealanders with serious criminal convictions to get into Australia simply by checking ‘no’ to the criminal convictions question on the incoming passenger card. Over the past couple of weeks, the media has reported on a number of New Zealand criminals who have moved to Australia only to re-offend multiple times.  And we aren’t talking about petty crimes here - some criminals settling into Australia have convictions for offences as serious as rape, manslaughter, kidnapping and robbery.

So what does this announcement mean for New Zealanders moving to Australia? Honest New Zealand citizens with no criminal record have nothing to worry about. You can continue to come and go freely between New Zealand and Australia for holidays or to live and work. But for New Zealanders with criminal convictions, it means you need to make a true declaration on your incoming passenger card or you will almost certainly be found out.

The best option for New Zealanders with a criminal record is to get prior permission from the Australian High Commission before attempting to arrive in Australia - whether it be for a holiday or to settle permanently. This means you’ll know in advance whether you’ll be allowed to travel there and for how long. All cases are assessed individually and are dependant on the seriousness of the convictions, so you may still get permission to visit or live in Australia despite your past.

To apply for permission to enter Australia with criminal convictions, download the consent form here and follow the instructions: http://www.australia.org.nz/wltn/VisaFAQ.html#criminal

Also, check out the criminal convictions category in our forum and read the coverage in The Australian.
